Protection of personal data – start date of European Regulation no. 2016-679 (GDPR)

The Municipality of Bordeaux has to process personal data as part of its public service obligations. In so doing, it is subject to the provisions of European Regulation no. 2016/679 (the General Data Protection Regulation, also known as “GDPR”) which came into force on 25 May 2018. This regulation bolsters the data protection obligations and the protection of data subjects until then defined by France’s data protection law no. 78-17.

What counts as the processing of personal data?
Any manual or computer processing of data providing a means of directly or indirectly identifying natural persons (for instance, family name, first name, photograph, personal e-mail address, national ID card number, location data, data inherent to the data subject’s physical, physiological, economic identity, etc.).

What kind of protection do data subjects benefit from when their personal data is processed by the Municipality of Bordeaux?
Whenever a data subject’s personal data is processed, transparent, concise and comprehensive information must be provided to the data subject at the time of the gathering of the data, in principle. This information must enable the data subjects to understand the purpose of the processing of their data and help them to stay in control of their data by facilitating the exercising of their rights of opposition, access, rectification, erasure, limitation, and portability.

General Security System (French acronym: RGS)

In accordance with Article 9 of France’s circular no. 2005-1516 dated 8 December 2005 concerning electronic correspondence between the users of public services and the authorities and between separate public authorities, France’s decree no. 2010-12 of 2 February 2010 applying Articles 9, 10 and 12 of the circular, and the Prime Ministerial circular dated 6 May 2010, the services provided remotely by the Municipality of Bordeaux are covered by a security certification.
